DELIVERY TERMS

1 | Product Variation & No-Return Policy

 

For more than 30 years our yard has remained free of fire ants, nematodes, and similar pests. To protect that record we cannot accept returns once material has been unloaded at your site.

 

To be certain you receive the product you want, please keep the following in mind:

 

  • See it first. It is highly recommended that you have physically visited our yard to choose your product(s).

  • Natural variation.

    • Volcanic cinder colors change with each vein mined; today’s red may differ from next month’s.

    • Cinder blends may contain more or less black cinder at any given time.

    • Listed sizes are approximate. A “1½-inch” rock can include occasional pieces up to about 3 inches.

  • Invoice double-check. Confirm that the product name and quantity shown on your invoice match what you intend to buy.

  • Final confirmation at delivery. Before dumping, inspect the load (ask the driver). If it is not what you expected, inform the driver immediately.

  • No refunds. If the delivered product matches the invoice and no issues are raised before unloading, the sale is final.

 

2 | On-Site Deliveries

 

2.1 Safe Access Requirements

You are responsible for providing safe, adequate access and a suitable dump area:

 

Small Dump Truck requires 15ft vertical clearance and 12ft horizontal clearance

Large Dump Truck requires 25ft vertical clearance and 12ft horizontal clearance

Both truck sizes require a reasonably flat surface for dumping.

 

If our driver determines the site is unsafe and no alternate location is available, the load will be returned to Soil Plus and the delivery fee will still apply.

 

2.2 Property-Damage Waiver

Heavy trucks can crack driveways, sidewalks, curbs, landscaping, underground lines, septic systems, and similar improvements. Soil Plus is not liable for any such damage.

 

2.3 Standby & Towing

  • Up to 30 minutes of on-site time is included.

  • Additional waiting time is billed at $90 per hour.

  • If the truck becomes stuck, you are responsible for all towing costs and any damage to the vehicle.
     

3 | Street / Shoulder Deliveries

If you request dumping on a public street, shoulder, or sidewalk, you accept full responsibility for any citations, claims, injuries, or property damage arising from that location and agree to indemnify and hold Soil Plus harmless.
 

4 | Payment = Acceptance

Payment of any invoice that references these Delivery Terms confirms that you have read, understood, and agreed to all provisions above. Refunds for credit card transactions due to customer-requested changes or cancellations are subject to a 3% fee to cover non-refundable processing costs. If you do not agree, please contact us before making payment to modify or cancel your order.
